1. Acceptance

By using ImagFly ("Service"), operated by GenXis, Inc. ("we", "us"), you agree to these Terms. If you don't agree, don't use the Service.

2. What ImagFly Does

ImagFly is an AI-powered image optimization tool. You provide images (via upload, URL, or mobile share), and we generate optimized versions for thumbnails, covers, and marketing materials.

3. Your Content & Rights

You represent and warrant that:

• You are the original creator of the images you submit, OR you have explicit permission from the rights holder to modify and use them.
• Your use of optimized images complies with the terms of service of any platform they will be published on (YouTube, Instagram, TikTok, etc.).
• You will not submit images containing illegal content, hate speech, or content that infringes on third-party rights.

We do not claim ownership of your images. You retain all rights to your original content. You grant us a limited, temporary license to process your images solely for the purpose of providing the optimization service.

4. Intellectual Property

AI-optimized output images are yours to use. However, you are solely responsible for ensuring your use of optimized images does not infringe on any third-party intellectual property rights, including but not limited to copyrights, trademarks, and rights of publicity.

5. Image Processing & Storage

• Uploaded images are processed in real-time and stored temporarily for delivery.
• Optimized images are hosted on our CDN (images.link) for download and sharing.
• We may retain processed images for up to 30 days for caching and delivery purposes.
• We do not sell, license, or use your images for training AI models.

6. Billing & Credits

• Free tier: watermarked preview optimization, no account required.
• Paid features (full-res download, CDN hosting, SEO, brand injection) require a 50c API key with available credits.
• Credits are non-refundable once consumed. Pricing is displayed before each action.
• We reserve the right to change pricing with 30 days notice.

7. Prohibited Uses

You may not:

• Submit images you don't have rights to modify
• Use the Service to generate misleading, deceptive, or fraudulent content
• Reverse-engineer, scrape, or abuse the API
• Resell the Service without written permission
• Use automated tools to submit bulk requests without an API key

8. Disclaimer

The Service is provided "as is" without warranties. We don't guarantee that optimized images will improve your click-through rates, engagement, or revenue. AI optimization results vary.

9. Limitation of Liability

GenXis, Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes

We may update these Terms at any time. Continued use after changes constitutes acceptance. We'll post the updated date at the top of this page.
